The terms "we", "us" and "our" refer to The Sirius Studio, a brand and sole proprietorship owned and operated by Abhirama Kanekar, registered in Maharashtra, India. The Sirius Studio operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores. All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS When you place an order, you are making an offer to purchase. The Sirius Studio reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until The Sirius Studio confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as The Sirius Studio may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. Your purchases are subject to our strict Return & Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export without our prior written consent.

SECTION 4 - PRICES, BILLING, AND CUSTOMS Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

  • Domestic (India): Unless otherwise stated, product prices for Indian residents include applicable GST and standard shipping.

  • International: For international orders (including the USA and Europe), product prices do not include your local import duties, customs clearance fees, or local taxes (such as VAT). As outlined in our Shipping Policy, all international shipments are Delivered Duty Unpaid (DDU/DAP), and the buyer is strictly responsible for all local customs fees.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes and duties.

SECTION 5 - SHIPPING, DELIVERY, AND FORCE MAJEURE We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control. Once we transfer products to the carrier, title and risk of loss passes to you. The Sirius Studio shall not be held liable for any direct, indirect, financial, or emotional losses—including but not limited to stress, inconvenience, loss of business, or missed event deadlines—arising from any delays in order processing, dispatch, or delivery. Force Majeure: We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure, acts of God, global pandemics, labor disputes, customs embargoes, or government actions.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by The Sirius Studio, its affiliates or licensors and are protected by Indian and international intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. All rights not expressly granted herein are reserved by The Sirius Studio.

SECTION 7 - OPTIONAL TOOLS You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. We are not liable for any harm or damages related to your access to any third-party websites.

SECTION 9 - AI TRANSPARENCY AND GENERATIVE CONTENT DISCLAIMER

To ensure full transparency and compliance with international consumer protection standards, including the EU Artificial Intelligence Act and US Federal Trade Commission guidelines, we disclose the following regarding the creation of our products:

1. Use of Artificial Intelligence: The artwork, designs, and visual graphics featured on our products are created using a hybrid approach that includes Artificial Intelligence (AI) generative software, combined with human curation, digital painting, compositing, and manual editing by our design team. By purchasing from The Sirius Studio, you acknowledge and understand that the core imagery of the physical product you receive was generated, in whole or in part, utilizing machine-learning AI tools.

2. Product Representation and Artifacts: Due to the nature of generative AI, the digital representations of artworks on our website may contain minor visual artifacts, blending, or unconventional stylistic elements inherent to machine-generated imagery. These are not considered manufacturing defects. We make every effort to refine these designs manually; however, you accept that the artistic style is partially algorithmic.

3. Intellectual Property of Final Goods: While purely AI-generated base images may not be subject to traditional human-authorship copyright protections in certain jurisdictions, the final physical product, our unique human-authored edits, the curation, and the compilation of these designs remain the exclusive commercial property of The Sirius Studio. You are purchasing a physical good for personal, non-commercial use, and this purchase does not transfer any underlying copyright or commercial reproduction rights to you.


SECTION 10 - RELATIONSHIP WITH SHOPIFY The Sirius Studio is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Sirius Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Sirius Studio, and you expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with us.

SECTION 11 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

Agents must: (i) identify that the request is from an Agent in all HTTP/HTTPS requests; (ii) not conceal or obfuscate that any access is from an Agent (e.g., bypassing CAPTCHAs); and (iii) not circumvent any measure intended to block or limit Agent access.

SECTION 16 - TERMINATION We may terminate this agreement or your access to the Services in our sole discretion at any time without notice. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

SECTION 18 - LIMITATION OF LIABILITY TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL THE SIRIUS STUDIO, ABHIRAMA KANEKAR, OUR DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

SECTION 19 - INDEMNIFICATION You agree to indemnify, defend and hold harmless The Sirius Studio, Abhirama Kanekar, Shopify, and our affiliates, partners, and employees from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

SECTION 20 - DISPUTE RESOLUTION, BINDING ARBITRATION, AND CLASS ACTION WAIVER Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. If a dispute arises between you and The Sirius Studio, our goal is to resolve it quickly and cost-effectively. You agree to first contact us directly at hello@thesiriusstudio.in to seek an informal resolution. If we cannot resolve the dispute informally, you and The Sirius Studio agree that any claim or dispute at law or equity that has arisen or may arise between us relating in any way to or arising out of this or previous versions of these Terms, your use of or access to the Services, or any products purchased through the Services, will be resolved in accordance with the provisions set forth in this section.

  • Binding Arbitration: Any dispute, claim, or controversy shall be determined by binding arbitration in Thane, Maharashtra, India, in accordance with the Indian Arbitration and Conciliation Act, 1996. The language of the arbitration shall be English.

  • Class Action Waiver: YOU AND THE SIRIUS STUDIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

SECTION 21 - SEVERABILITY & WAIVER In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

SECTION 22 - ENTIRE AGREEMENT & ASSIGNMENT These Terms of Service and any policies posted by us constitute the entire agreement and understanding between you and us, superseding any prior agreements. You may not assign this Agreement or any of your rights without our prior written consent. We may assign these Terms without notice to you.

SECTION 23 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Subject strictly to the binding arbitration clause in Section 19, you consent to the exclusive jurisdiction of the courts located in Thane, Maharashtra, India.

SECTION 24 - CHANGES TO TERMS OF SERVICE We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
